ARTICLE 2 – PURPOSE
The purpose of these General Terms and Conditions is to define the terms and conditions for participation in BOOME's affiliate program (hereinafter "the Program").
The Program allows affiliates to receive commissions in exchange for promoting products sold on the website www.boomeparis.com (hereinafter "the Site").
ARTICLE 3 – ELIGIBILITY AND REGISTRATION CONDITIONS
3.1 Eligibility conditions
Any natural person aged at least 18 or legal entity may submit an application to the Program.
3.2 Registration procedure
Registration for the Program is done via the dedicated form available on the Site. Each application is reviewed by BOOME within a few working days.
BOOME reserves the right to accept or reject any application, without having to justify its decision.
If accepted, the affiliate will receive their personalized affiliate link by e-mail, along with the communication guidelines to follow.
ARTICLE 4 – PROGRAM OPERATION
4.1 Affiliate link
Each affiliate has a unique and personalized affiliate link. This link allows:
- To offer a 10% discount to new customers on their first order
- To track sales generated by the affiliate
4.2 Sales tracking
Sales tracking is done via a 7-day cookie. A commission is attributed to the affiliate when a customer:
- Accesses the Site via the affiliate link
- Places an order within 7 days of this visit
- Uses the same browser, without having cleared their cookies or used private browsing
Tracking does not work if the customer leaves the Site and then returns in private browsing, on another browser, or after having cleared their cookies.
4.3 Dashboard
The affiliate has access to a dashboard on the Social Snowball platform (https://app.socialsnowball.io) allowing them to track their sales, commissions, and payments.
ARTICLE 5 – COMMISSIONS
5.1 Commission amount
The default commission rate is 10%, calculated on the amount excluding taxes and shipping costs of each order placed via the affiliate link. The default discount offered to customers is 10% on their first order.
As an example, with default rates, an order of €120 including tax with free shipping generates a commission of €10.
BOOME reserves the right to:
- Propose different commission and discount rates depending on the affiliates, particularly in the context of specific programs
- Modify the applicable commission and discount rates at any time, temporarily or permanently
The rates applicable to each affiliate can be viewed at any time from their dashboard on the Social Snowball platform.
5.2 Excluded commissions
Commissions do not apply to:
- Returned orders
- Canceled orders
- Refunded orders
5.3 Commission cap
There is no limit on the total amount of commissions an affiliate can receive.
ARTICLE 6 – PAYMENT TERMS
6.1 Minimum payment threshold
The minimum payment threshold for commissions is set at €1.
6.2 Payment methods
The affiliate can choose from the following payment methods:
- Virtual Visa card (no fees)
- Gift card to partner brands (no fees)
- Donation to partner associations (no fees)
- PayPal (no fees)
- Bank transfer (6% fees)
At each payment cycle, the affiliate receives an e-mail allowing them to select their payment method and collect their commissions.
6.3 Payment schedule
Commissions are paid every Friday for orders that are:
- Not canceled and not refunded
- Whose shipping date is at least 45 days old
This period corresponds to the maximum processing time for returns (package return by the customer, processing in the logistics warehouse, refund).
If the order is less than 45 days old, the commission will be carried over to the next payment cycle.
ARTICLE 7 – AFFILIATE OBLIGATIONS
7.1 Authorized practices
The affiliate can promote their affiliate link via:
- Their own social media accounts (posts, stories, bio)
- Their personal blog
- Direct sharing with their close ones
7.2 Prohibited practices
It is strictly prohibited to:
- Disseminate their affiliate link via paid advertisements (Meta, Google, TikTok, etc.)
- Comment on their affiliate link on BOOME's posts or advertisements on social networks
- Share their affiliate link on promo code platforms or blogs disguised as sites referencing promo codes for different brands
- Use their affiliate link to place an order themselves
- Resort to spam practices or any other technique considered unethical
7.3 Communication guidelines
The affiliate agrees to comply with the communication guidelines transmitted to them upon their acceptance into the Program. These guidelines notably govern the authorized claims concerning BOOME products.
The affiliate is prohibited from making unauthorized medical or therapeutic claims regarding the products.
7.4 Modification of the affiliate link
BOOME reserves the right to modify an affiliate's link at any time, especially when it has been taken over by promo code platforms. The affiliate will be informed by e-mail of any link change.
ARTICLE 8 – CANCELLATION OF COMMISSIONS
A commission may be canceled in the following cases:
- The associated order has been returned, canceled, or refunded
- The affiliate link has been shared in a manner inconsistent with these General Terms and Conditions
- The order was placed by the affiliate themselves
ARTICLE 9 – EXCLUSION FROM THE PROGRAM
9.1 Exclusion for non-compliance with conditions
BOOME reserves the right to ban any affiliate who does not comply with these General Terms and Conditions, and to cancel all of their commissions.
9.2 Inactivity
In case of inactivity of an affiliate for a period exceeding 12 months, BOOME reserves the right to deactivate their account.
9.3 Fate of commissions in case of exclusion or departure
In case of exclusion or departure from the Program, pending commissions are canceled.
ARTICLE 10 – VALIDATION OF COMMISSIONS
BOOME reserves the right to validate or reject any commission at its sole discretion.
ARTICLE 11 – LIABILITY
11.1 BOOME's liability
BOOME cannot be held responsible for technical malfunctions of the Social Snowball platform or any other third-party tool used within the framework of the Program.
BOOME does not guarantee any minimum income level to affiliates.
11.2 Affiliate's liability
The affiliate is solely responsible for the content they publish to promote BOOME products. They undertake to comply with current legislation, particularly regarding advertising and consumer protection.
The affiliate undertakes to declare their income from the Program in accordance with applicable tax regulations.
ARTICLE 12 – PERSONAL DATA PROTECTION
12.1 Data collected
Within the framework of the Program, BOOME collects the following personal data:
- First and last name
- Email address
- Payment information (bank details or PayPal account)
- Performance data (sales generated, commissions)
12.2 Purpose of processing
This data is processed for:
- Management of the affiliate program
- Payment of commissions
- Communication related to the Program
12.3 Legal basis
Data processing is based on the performance of the affiliate agreement.
12.4 Retention period
Data is retained for the entire duration of participation in the Program, then for the applicable legal retention period.
12.5 Affiliate's rights
In accordance with the General Data Protection Regulation (GDPR), the affiliate has the following rights:
- Right to access their data
- Right to rectification
- Right to erasure
- Right to restriction of processing
- Right to data portability
- Right to object

The affiliate also has the right to lodge a complaint with the French National Commission for Informatics and Liberties (CNIL).
ARTICLE 13 – MODIFICATION OF GENERAL TERMS AND CONDITIONS
BOOME reserves the right to modify these General Terms and Conditions at any time.
Affiliates will be informed of any modification by e-mail at least 7 days before the new conditions come into effect.
Continued participation in the Program after the entry into force of the modifications constitutes acceptance of the new General Terms and Conditions.
ARTICLE 14 – DURATION AND TERMINATION
14.1 Duration
Participation in the Program is concluded for an indefinite period.
14.2 Termination by the affiliate
The affiliate can withdraw from the Program at any time by contacting BOOME at affiliation@boomeparis.com.
14.3 Termination by BOOME
BOOME may terminate an affiliate's participation at any time, particularly in the event of non-compliance with these General Terms and Conditions, subject to 7 days' notice, except in the event of a serious breach.
ARTICLE 15 – APPLICABLE LAW AND DISPUTES
These General Terms and Conditions are subject to French law.
In the event of a dispute relating to the interpretation or execution of these General Terms and Conditions, the parties shall endeavor to find an amicable solution.
Failing an amicable agreement, any dispute will be submitted to the exclusive jurisdiction of the courts of Paris.
The affiliate is informed that they can, in any case, resort to conventional mediation, whose references appear on the Website.
In accordance with the provisions of Title I of Book VI of the Consumer Code, Boome has designated the CMAP (Centre de Médiation et d'Arbitrage de Paris, 39 avenue Franklin D. Roosevelt, 75008 Paris) as consumer mediator.
The CMAP can be contacted by the consumer for a mediation request via the online form, accessible on the website www.cmap.fr; Consumer page, after having sent a written complaint to Boome, which remained unanswered more than one month after its dispatch, or having received an unsatisfactory response.
ARTICLE 16 – ACCEPTANCE OF GENERAL TERMS AND CONDITIONS
Registration for the affiliate Program implies full and complete acceptance of these General Terms and Conditions.
